  1. TERMS OF USE OF THE PORTAL

1.1 General

The User agrees to make correct use of the portal in accordance with the Law and this Legal Notice. The User will be liable to AIE or against third parties for any damages and losses that may be caused by the breach of such obligation.

Use of the portal for purposes that are harmful to goods or interests of AIE or third parties, or that in any way overload, damage or render useless the networks, servers and any other computer equipment (hardware) or software products and applications of AIE or third parties, is expressly prohibited.

1.2. Responsibility in the use of contents

The User agrees to make correct use of the Contents in accordance with the Law and this Legal Notice.

For illustrative purposes only, and in accordance with current legislation, the User undertakes not to:

Reproduce, copy, distribute, make available, communicate publicly, transform or modify the Contents except in cases authorized by law or expressly consented to by AIE or by the person holding the ownership of the exploitation rights where appropriate.

Reproduce or copy for private use the Contents which may be considered as software or database in accordance with the current legislation on intellectual property, as well as its public communication or ‘making available’ to third parties when these acts necessarily involve the reproduction by the User or third parties.

Extract and/or reuse the whole or a substantial part of the Contents contained in the portal, as well as of the databases that AIE makes available to the Users.

1.3 Forms of data collection

All information provided by the User through the relevant forms of the portal, for the purposes above specified or any other, shall be truthful and accurate. For this purpose, the User ensures the authenticity of all data provided and will keep fully updated the information provided to AIE so that it responds, at any time, to the real situation of the User. In any case, the User will be the sole responsible for any false or inaccurate statement made and for any damage caused to AIE or third parties for the information provided.

2.1 For information

Access to the portal does not imply any obligation on the part of AIE to verify the truthfulness, accuracy, adequacy, suitability, completeness and timeliness of the information supplied through it. The contents of this website have a general nature and do not constitute in any way the provision of a legal or tax advice service of any kind. Therefore, this information is insufficient for any personal or business decision-making by the User.

AIE is not responsible for the decisions taken from the information supplied in the portal, neither for any damage or loss caused to the User or third parties due to actions based solely on the information gathered from the portal.

2.2 For service quality

Access to the portal does not imply any obligation on the part of AIE to control the absence of viruses or any other harmful computer elements. In any event, the User will be responsible for the availability of adequate tools for the detection and disinfection of harmful computer software.

AIE is not responsible for any damage produced in the computer equipment of the Users or third parties during the provision of the relevant portal service.

2.3 For availability of the service

Access to the portal requires a series of services and supplies from third parties, including transportation through telecommunications networks whose reliability, quality, continuity and operation does not correspond to AIE. Consequently, any service provided through the portal may be suspended, cancelled or inaccessible, prior or simultaneously to the provision of the relevant portal service.

AIE is not responsible for any damage or loss of any kind caused to the User and resulting from failure or outage of telecommunication networks which may result in the suspension, cancellation or interruption of the relevant portal service during the provision of the service or prior to this.

2.4. For contents and services linked through the portal

Access service to the portal includes a series of technical linking devices which allow the User to access other pages and Internet websites. In such cases, AIE acts as an intermediary service provided in accordance with Article 17 of Law 34/2002 of 12 July on Information Society Services and Electronic Commerce (LSSI) and will only be responsible for the contents and services supplied in other websites to the extent that it has effective knowledge of the wrongfulness and has not deactivated the link with due diligence.
